Gammix Limited strongly criticizes the "unfounded and exorbitant" €19.7m KSA penalty

The operator vows to fight against the Dutch regulator’s ‘unjust’ ruling

Gammix Limited intends to contest the penalty imposed by the Netherlands Gaming Authority (KSA), which they believe is “outrageous and unsubstantiated.” The penalty amounts to €19.7 million and is based on what Gammix considers to be falsified data, extreme inaccuracy, and highly suspect mathematics.

The regulator accused Gammix of allowing online gambling access for Dutch consumers and not requiring age verification upon sign-up, allegations that the company vehemently denies. Gammix argues that the accounts used to access its sites during the investigation were created in Luxembourg, violating the sites’ terms and conditions by providing false information upon sign-up.

The penalty, totaling €19,679,000, was calculated using figures from a proprietary web-traffic aggregation service and a multiplier of 240 Euros per click, according to Gammix. The company believes that this calculation artificially inflates their turnover.

Gammix also criticizes the KSA’s “mystery shopper” style of investigation and considers it an unfair basis for imposing the record-breaking penalty.

Gammix’s Director, Phil Pearson, vows to “fight on all fronts until it receives an apology and retraction” from the KSA. He states that the penalty is outrageous and unsubstantiated. Pearson highlights the company’s efforts to comply with guidelines and communicate with the regulator, but their requests and inquiries were seemingly ignored by the KSA.

Pearson explains that Gammix had implemented blocks for Dutch IP addresses, didn’t have Dutch language or direct Dutch payment methods, and did not actively target Dutch traffic. However, the company cannot be held responsible if affiliates list their brands on Dutch-facing sites. Once players reached Gammix’s sites, they would be unable to register an account.

The company intends to contest the penalty at every possible turn, seeking to have it rescinded and receive the apology they believe they deserve.
